    C. Drawing winners

    15. The draw will be conducted at 15:00 pm AEST on Friday 10th August 2018 at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250.

    16. Once the winner has been contacted, the winner may be announced on Velocity’s website www.velocityfrequentflyer.com.au after 12 pm AEDT two business (2) days after the draw has occurred. The Winners will be notified after 12 pm AEDT on Tuesday 14th August 2018 directly by phone and email where further contact information and details may be requested including, but not limited to, full name, phone number, email address and residential address.

    17. If the prize is not claimed by Wednesday 26th September 2018, a redraw will be conducted.     19. Entries not fully complying with these Conditions of Entry may be deemed invalid at the Promoter’s discretion. If a winning entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and the relevant prize will be re-awarded with the relevant clause of the Conditions of Entry as if the discarded entry had not been received.

    20. All decisions of the Promoter are final and no discussion or correspondence with be entered in to.

    D. Prize

    22. The prize pool consists of:

Winners will not be entitled to any fee for participating in these activities.

    F. Intellectual Property

    31. If this Promotion requires an Entrant to create any written material, imagery or sound recordings, the provisions in this Section F apply.

    32. As a condition of entering this Promotion, the Entrant warrants to the Promoter that: a. The entry does not infringe the intellectual property rights or moral rights of any third party; and b. The Entrant has obtained permission from any third party appearing or participating in the entry.

    33. As a condition of entering this Promotion, Entrants hereby assign to the Promoter, all right, title and interest in and to all intellectual property rights (including copyright but excluding moral rights) in any material created pursuant to the Entrant’s participation in any aspect of the Promotion (Works). Entrants acknowledge that the Promoter is free to use the Works and to exercise its rights in relation thereto and the Entrant will not be entitled to any fee for such use. Entrants agree they may not be attributed as the author of the Works and that the Promoter may undertake any act or omission in relation to the Works, which may otherwise constitute an infringement of their moral rights.

    34. The Promoter may want a Winner to participate in promotional activity after the Promotion has ended. In consideration for the Promoter awarding the prize to a Winner, the Winner permits the Winner’s image and/or voice, as recorded, photographed or filmed during the Winner’s participation in the prize to appear in any media whatsoever throughout the world for an unlimited period and the Winner will not be entitled to any fee for such use.

    35. The Promoter reserves the right to request that a Winner provides proof of identity, proof of age, proof of residency and/or proof of entry validity in order to claim a prize.     G. Tax

    36.     38. Entrants should seek independent financial advice to ensure they understand possible tax implications in relation to any tax liability and/or reportable fringe benefits before acceptance or use of a prize.

    39. The Promoter not accept responsibility for and makes no representations about any tax liability as a result of participating in the Promotion or from receiving or using any of the prizes.

    40. The other party must ensure that all promotional and marketing material prepared by the other party relating to the Promotion sufficiently notifies Entrants of the above conditions.

    H. Legal

    42.     Entry

    4.     Entry is open to members with a valid Velocity Frequent Flyer and valid flybuys membership account aged 18 years and over (Entrants).     Drawing winners

    12.   There will 5 major winners (a Major Winner) and 100 minor winners (a Minor Winner) in total. Entrants can only be a Winner once. Winners will be drawn according to the schedule in clause 14.

    13.   The Prizes will be awarded to the Entrant named in the entry.

    14.   The draw will be conducted in accordance with the draw table below at 3.00pm AEST at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250.

The Winner will be notified after 10:00 am AEST seven (7) days after the draw has occurred directly by phone or email where further contact information and details will be requested including, but not limited to, full name, phone, email, and address.  A winning entry may be published on the Promoter's Facebook page or website.

    16.   If a Winner is drawn and that person has already been a Winner previously, a redraw will be conducted on the same date as the original draw.

    17.   If a prize is not claimed within three (3) months of publication, a redraw will be conducted. If required, the redraw will be conducted from 30 October 2018 at 3:00 pm AEST at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250.

    18.   A redrawn Winner will be notified by phone two (2) days after the draw, and in writing two (2) days after the draw. The name and state of the re-draw Winner may be published on the Velocity Frequent Flyer website fourteen (14) days after the re-draw.

    19.   Entries not fully complying with these Conditions of Entry may be deemed invalid at the Promoter’s discretion. If a winning entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and the relevant prize will be re-awarded in accordance with the relevant clause of these Conditions of Entry as if the discarded entry had not been received.

    20.   All decisions of the Promoter are final and no discussions or correspondence will be entered into.

    Prizes

    22.   There are 5 major prizes and 100 minor prizes in total. The total prize pool is valued at $25,208.70.

    23.   There are five (5) Major Prizes valued at AUD$24,707.80 collectively (based on exchange rates as at 10 May 2018) to be won of:

    a.     The Winner will be given further instructions on how to redeem the flight prize via email upon being notified they are a Winner.

    b.     If for any reason, the Winner does not, once the flights have been booked, notify Virgin Australia at least 24 hours prior to scheduled departure that they are unable to take the booked flight at the time stipulated, their prize will be forfeited and cannot be redeemed for cash.

    c.     All travel must be on Virgin Australia operated flights with a VA flight number.  Bookings must be finalised and ticketed by 30 November 2018 and at least fourteen (14) days prior to departure, and are subject to availability at the time of request.  Travel must be completed by 31 July 2019.  The Winner and their nominated travel companions must be booked in the same record and travel together on all flight sectors.

    26.   The following additional terms apply to the Shangri-La’s Fijian Resort and Spa accommodation Prize:

    a.     Reservations cancelled less than seven (7) days prior to arrival will incur one (1) nights room charge. In the event of non-arrival, a full room charge will be levied.

    b.     The Winner will be given further instructions via email on how to redeem the accommodation Prize upon being notified they are a Winner.

    c.     The accommodation Prize is for five (5) nights for 2 adults. Daily breakfast for 2 adults is included. Any additional nights will be at the Winners’ own expense.

    Contacting the Entrant

    Intellectual property

    32.   The Promoter may want a Winner to participate in promotional activity after the Promotion has ended. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and actual club usage before issuing a prize and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

    6. This is a game of skill and chance plays no part in determining the winners.  Photos will be judged on their originality and creativity, with the most creative and original photos deemed the winners by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

    7. Internet entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, incomprehensible, or illegible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.

    8. The judging will take place at 2a Defries Avenue, Zetland, NSW 2017. The judges reserve the right to select additional reserve entries which they determine to be the next most creative and literate entries, and record them in order of merit, in case of an invalid entry or ineligible Entrant. The winners will be notified in writing via Facebook or Instagram comment.

    9. Prizes and prize winners: 12 entries judged to be the best from all eligible weekly entries will receive 100,000 Velocity points. A competition week commences from 12:00am Monday to 11:59pm Sunday each week between 30 April and 29 July 2018. 

    10. Points are not transferable or exchangeable. Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any variation in prize value.

    11. Velocity points will be credited to winning members’ accounts within 5 days of the notification of winning a prize. Please be sure to update your Velocty number in mylocker before entering the competition.

    12. All additional costs not expressly stated, but which may be incurred in acceptance and use of the prizes are the responsibility of the winner. Such additional costs include, but are not limited to, adding costs in booking flights or redeeming awards.

    13. If a prize is unavailable for any reason beyond the Promoter’s reasonable control, then a substitute prize (or that part of the prize) of equal or greater value and/or specification will be awarded in lieu.

    14. All entries submitted become the property of the Promoter. As a condition of entering into this promotion, each Entrant agrees to assign all of his or her rights, title and interest (including copyright) in and to their entry to the Promoter. Each Entrant warrants to the Promoter that each entry submitted is an original work of the Entrant that does not infringe the rights of any third party. Each Entrant also warrants to the Promoter that they have the authority and all permissions necessary to submit their entry into the promotion, including but not limited to obtaining any required written consents and releases to reference or identify any third party in their entry (if applicable). The Entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of any of these warranties. Entrants consent to any use of their entry, which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

    15. As a condition of entering this promotion, an Entrant consents to the Promoter using the Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents.

    16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the promotion, and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes.

    17. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the Promoter’s sole discretion, is considered to be offensive or inappropriate in any way (including any objectionable content, profanity, potentially insulting, inflammatory or defamatory statements) or that the Promoter considers, may infringe any intellectual property rights or other rights of any person, corporation or entity. This includes, but is not limited to, any entry which the Promoter considers to be disparaging to its products and/or services.

    18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; (f) the acceptance or use of a prize; and (g) any act or omission of the Promoter or its associated agencies.

    19. As a condition of accepting the prize, the winners (and any companion/s) may be required to sign any legal documentation as and in the form required by the Promoter / prize supplier / organisers in their absolute discretion including but not limited to a legal release and indemnity form.

    20. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information in order to conduct the promotion, to include the Entrant in the promotion and, where appropriate, award prizes. The Promoter may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers, to assist in conducting the promotion. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible.
